New Resource on Nursing Home Rule

Consumer Voice is pleased to provide you with this new resource, Summary of Key Changes in the Rule – Phase 2.
 
This summary sheet is designed to provide an overview of key changes in the revised federal nursing home regulations that went into effect November 28, 2017 as part of Phase 2.  The purpose of the summary is to highlight what is different (new or modified) between the prior rule and the final rule.

Residents' Rights Fact Sheets Available in Other Languages

The newly updated residents' rights fact sheets are now available in Spanish, French and Chinese.  Residents’ Rights are guaranteed by the federal 1987 Nursing Home Reform Law. The law requires nursing homes to “promote and protect the rights of each resident” and places a strong emphasis on individual dignity and self-determination.  Promote these essential rights with the Residents' Rights Fact Sheets.  Download and print the fact sheets free from our website or purchase a pack of 25 in our online store.  (The English version is available on our website here or for purchase from our online store.)

CMS Proposal Lists Only One Quality Measure for Nursing Homes

The Centers for Medicare & Medicaid Services' (CMS) list of potential Medicare quality measures included only one measure aimed at skilled nursing providers.  This year's list of measures under consideration included 32 quality measures total, compared to nearly 100 included in last year's proposed list.  The measure being considered for nursing homes pertains to short-stay discharges.  It would include a discharge questionnaire and would calculate the percentage of residents discharged within 100 days of admission who were satisfied with their care.  For more information about the list of potential Medicare quality measures and the discharge questionnaire, read the article in McKnight's.

Newsletter on Elder Justice "No Harm"

The Long Term Care Community Coaltion and the Center for Medicare Advocacy have published a newsletter - Elder Justice: What "No Harm" Really Means for Residents. Federal data indicate that resident harm is only identified in about 5% of all nursing home health deficiencies, which include deficiencies related to abuse, neglect and substandard care. The goal of the newsletter is to shed light on the issue of so-called “no harm” deficiencies and their impact on the safety and well-being of nursing home residents.
