Updated FAQs from ACL About the Long-Term Care Ombudsman Program

The Administration on Community Living has updated frequently asked questions (FAQs) to assist State Agencies on Aging, States' Long-Term Care Ombudsman Programs, and other entities that work with Ombudsman programs with implementation of the State Long-Term Care Ombudsman Programs Rule. The FAQs cover ombudsman authority to resolve complaints about the guardian or other representative of a resident, conflicts of interest of supervisors, intake processes to handle inquiries, appropriateness of people conducting ombudsman program activities, ombudsman program staff with professional licensing requirements, and court orders to disclose ombudsman program information. NCEA's "Home for the Holidays" Fact Sheet

The National Center on Elder Abuse's fact sheet, "Home for the Holidays," provides a list of things to consider discussing with loved ones when you visit over the holidays.  Holiday visits present a good opportunity to have conversations about care and to make sure your loved one has the supports needed to safely age in place.  This fact sheet provides information on warning signs and how to respond if your loved one is at risk of being abused. It's Giving Tuesday!

Today, Consumer Voice is participating in #GivingTuesday, a global day dedicated to giving.

Last year, more than 45,000 organizations in 71 countries came together to participate in #GivingTuesday.  Since its founding in 2012, #GivingTuesday has inspired giving around the world, resulting in greater donations, volunteer hours, and activities that bring about real change in communities.

  1. Analyzing the newly revised nursing home regulations, assuring that the consumer voice is being heard in the development of new guidance by CMS, and educating consumers and advocates about the changes;
  2. Supporting the newly created Consumer Advisory Council, made up of individuals receiving care and services in long-term care facilities and in community-based settings; and
  3. Responding to potential efforts to rescind federal nursing home standards, elder justice protections, or to block grant Medicaid - each of which would have negative impact on individuals receiving long-term care and services.

CMS Report Shows Majority of Participants in HCBS Are Older Adults and/or People with Disabilities

The Centers for Medicare & Medicaid Services has released a report showing that the majority of recipients of home- and community-based services funded through Medicaid Section 1915(c) waivers are older adults and/or people with disabilities.  Yet, the report also revealed that the average dollar amount spent per participant and the duration of service provision for these individuals are less than they are for some other groups served by the waivers.  The waivers are used by states for HCBS-related expensives like case management, residential and day habilitation, supported employment, personal care, homemaker services, personal emergency response systems, assistive technology, home delivered meals, non-medical transportation and respite. In 2013, waivers for older adults and/or people with physical disabilities supported 54.2% of participants.  Most of the remaining participants received support waivers for people with developmental disabilities.  For more information, read the article from McKnight's Senior Living.
